GENERAL TERMS AND CONDITIONS OF CONTRACTING AND USE OF THE WEBSITE

In compliance with the provisions of Royal Legislative Decree 1/2007 of 16 November and Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, it is hereby reported that the owner of the website www.manlia.es (hereinafter, the “Website”) is:

Hereinafter, “MANLIA” or the “Company”.
These General Terms and Conditions govern the contracting of tourist accommodation services carried out through the Website between MANLIA and the users who contract (hereinafter, the “Client(s)”).

PURPOSE
The purpose of these General Terms and Conditions is to regulate the terms and conditions applicable to:
• The use of the Website by users.
• The online booking of tourist accommodation and associated services offered by MANLIA.
Access to and contracting through the Website imply full and unreserved acceptance of these General Terms and Conditions, as well as of the Legal Notice, the Privacy Policy, the Data Protection Policy and the Cookies Policy.
If the Client does not agree with any of the conditions set out herein, they must refrain from using the Website or making bookings through it.

CAPACITY TO CONTRACT
Only natural persons over 18 years of age who have sufficient legal capacity to be contractually bound, or duly represented legal entities, may contract services through the Website.
By making a booking, the Client declares and warrants that they meet these requirements.

BOOKING PROCESS
4.1. Selection of accommodation and dates
The Client may browse the Website, select the desired accommodation, and consult its description, features, approximate location, maximum occupancy, services included and price per stay.
The Client must indicate:
• Check-in and check-out dates.
• Number of guests.
• Any other data required in the form.
4.2. Data required for the booking
To formalise the booking, the Client must provide:
• First name and surname(s).
• Contact details (email, telephone).
• Billing details, if required.
• Payment details (managed through a secure payment gateway, POS terminal or other method established on the Website).
The Client undertakes to provide truthful, complete and up-to-date information and shall be liable for the consequences arising from any inaccuracy or falsity thereof.
4.3. Booking confirmation
Once the data have been entered and these General Terms and Conditions accepted, the Client shall proceed to confirm the booking and, where applicable, make the payment indicated (in whole or in part).
The contract shall be deemed concluded at the moment MANLIA displays the booking confirmation on screen and/or sends the Client a confirmation email with the booking details.
The booking receipt (confirmation screen and/or email) shall be the documentary proof of the contracting.

PRICES, TAXES AND OTHER CHARGES
5.1. Prices
The prices shown on the Website:
• Are expressed, as a general rule, in euros (€).
• Include legally applicable taxes (for example, VAT), unless expressly stated otherwise.
Prices may vary depending on:
• Dates of stay.
• Number of guests.
• Length of stay.
• Type of rate (standard flexible, non-refundable, promotions, etc.).
The applicable price will always be that which appears in the booking process at the time of contracting.
5.2. Cleaning fees and other services
Where applicable, the Website may itemise:
• Final cleaning fees.
• Service charges.
• Charges for additional services (cot, parking, etc.).
These items, where applicable, shall form part of the total price displayed and accepted by the Client before completing the booking.
5.3. Tourist taxes
If any tourist tax or other local tax not included in the price is applicable, the Client will be informed before completing the booking or in the description of the accommodation, indicating the method of payment (for example, payment at the accommodation).

METHODS OF PAYMENT
The Website will indicate in each case the available methods of payment to complete the booking (for example, credit/debit card, virtual POS, bank transfer, etc.).
Payment may be made:
• At the time of making the booking (full or partial payment).
• Or within the deadlines indicated in the booking process and/or in the confirmation email (for example, advance payment X days before arrival).
In the case of payment by card or other electronic means, secure and encrypted payment gateways shall be used. MANLIA does not directly store full bank card details, except to the strictly necessary extent and in accordance with the applicable security standards.
If the payment cannot be completed for reasons attributable to the Client (lack of funds, card declined, incorrect data, etc.), MANLIA may:
• Contact the Client to remedy the issue.
• Cancel the booking if payment is not regularised within the indicated period, applying, where appropriate, the cancellation policy in force.

CHECK-IN, CHECK-OUT AND RULES OF STAY
7.1. Check-in and check-out times
The standard check-in and check-out times shall be those indicated:
• In the accommodation listing.
• And/or in the booking confirmation email.
Any check-in or check-out outside this standard timetable (for example, early check-in or late check-out) shall be subject to:
• Availability of the accommodation.
• Possible additional charges, which shall be communicated in advance.
7.2. Guest registration
In accordance with the applicable tourism and public security regulations, MANLIA may require the Client and guests of legal age to provide:
• Identity document or passport.
• Data necessary for the entry form or guest registration.
The Client undertakes to provide this data truthfully and to cooperate in complying with these legal obligations.
7.3. Rules of conduct and use of the accommodation
During the stay, the Client and the other guests undertake to:
• Use the accommodation in a diligent and respectful manner.
• Respect the rules of the homeowners’ association and MANLIA’s specific instructions (noise, use of common areas, swimming pools, lifts, etc.).
• Not exceed the maximum occupancy indicated in the booking, unless expressly authorised.
• Not hold parties or carry out annoying, unhealthy, harmful, dangerous or unlawful activities.
• Not smoke inside the accommodation if this is expressly prohibited.
• Not accommodate animals if this is not permitted or has not been expressly agreed.
Serious or repeated breach of these rules may result in early termination of the contract, and MANLIA APARTMENTS may request the immediate departure of the Client and guests from the accommodation, without the right to a refund and without prejudice to any claim for damages that may apply.

CANCELLATION AND NO-SHOW POLICY
8.1. Scope of application
This cancellation policy applies, as a general rule, to bookings made directly through the Website www.manlia.es, unless:
• A different policy is indicated for a specific rate (for example, “non-refundable” rates).
• The bookings are made through third-party platforms (Booking.com, Airbnb, etc.), in which case the cancellation conditions of those platforms shall apply.
8.2. General cancellation condition (standard rate)
Unless expressly indicated otherwise in the selected rate, MANLIA’s general cancellation condition is as follows:
• The Client may cancel without penalty up to 7 calendar days before the scheduled arrival date.
• Any cancellation made within the 7 calendar days prior to the arrival date shall be considered non-refundable, meaning that no amount paid up to that time will be refunded.
In particular:
• If the Client has already paid all or part of the booking amount, such amount shall be non-refundable.
• If the rate policy provides for 100% advance payment within the 7 days prior to arrival, MANLIA may proceed to charge said amount as cancellation fees.
For the calculation of time limits, the local date and time of the accommodation shall be taken into account.
8.3. Cancellations of bookings made less than 7 days in advance
For bookings made less than 7 days before the arrival date:
• The Client acknowledges and accepts that the booking is non-refundable from the moment of contracting, unless otherwise agreed in writing.
• Any cancellation shall entitle MANLIA to retain or charge 100% of the booking amount as cancellation fees.
8.4. No-show
A “no-show” shall be deemed to occur when:
• The Client does not appear at the accommodation on the scheduled arrival date.
• The Client has not informed MANLIA of a delay in arrival within the check-in time.
In such cases:
• The booking shall be deemed cancelled by the Client.
• There shall be no right to a refund of amounts paid.
• MANLIA may charge 100% of the booking amount as a penalty, if it has not already done so.
8.5. How to request cancellation
Cancellations must be requested by any of the following means:
• Through the links or panels enabled on the Website itself, if available.
• By email to the address indicated in the booking confirmation.
• By other means that MANLIA may expressly indicate.
In all cases, the cancellation shall become effective when MANLIA confirms it in writing (normally by email), and the cancellation policy described in this section shall apply.
8.6. Right of withdrawal
The Client is informed that, in accordance with Article 103(l) of Royal Legislative Decree 1/2007, the right of withdrawal does not apply to accommodation services with a specific date or period of performance, and therefore there is no general 14-day period to withdraw without cause once the booking has been confirmed.
Without prejudice to the foregoing, the cancellation rules set out in these General Terms and Conditions and, where applicable, in the specific conditions of the contracted rate shall apply.

MODIFICATION OF BOOKINGS
Any modification to a booking (dates, number of guests, type of accommodation, etc.) shall be subject to:
• Availability of the accommodation.
• Possible rate changes and/or price supplements.
• Express acceptance by MANLIA.
Depending on when the modification is requested, the cancellation policy may be applied to the original or the new booking, as appropriate.

CANCELLATION OR MODIFICATION BY MANLIA
MANLIA may cancel or modify a booking in the following cases:
• Supervening impossibility of providing the service under the agreed conditions for reasons not attributable to MANLIA (for example, serious damage to the accommodation, flooding, prolonged supply cuts, force majeure, etc.).
• Obvious errors in the price or in the description of the accommodation, provided that the Client is informed as soon as possible.
• Serious breach by the Client of their obligations (payment fraud, improper use, etc.).
In such cases, MANLIA may:
• Offer the Client alternative accommodation with equal or superior characteristics, if possible and if the Client accepts it.
• Or proceed to refund the amounts paid, without the right to additional compensation, unless otherwise provided by law.

LIABILITY FOR DAMAGE TO THE ACCOMMODATION
The Client shall be liable for:
• Any damage and deterioration caused by them or the guests to the accommodation, furniture, furnishings or common areas, except for those arising from normal use.
• The loss of keys, access devices or similar items that have been provided to them.
MANLIA may:
• Charge the Client the cost of the damage, subject to justification.
• Use, where applicable, the deposit or security provided to cover such damage.
• Claim, judicially or extrajudicially, amounts exceeding the guarantees provided.

APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions are governed by Spanish law.
In the event of conflict or discrepancy in the interpretation or application thereof, the parties submit to the Courts and Tribunals of the city of Alicante, unless the Client is a consumer and mandatory regulations provide for the jurisdiction of the courts of their domicile.

AMENDMENT OF THE GENERAL TERMS AND CONDITIONS
MANLIA reserves the right to amend these General Terms and Conditions at any time and without prior notice, by publishing on the Website the updated version applicable to bookings made after such publication.
The date of the last update will appear at the end of this document.
